Charges against the four men accused of the murder of Hillary Gardee have been provisionally withdrawn due to the inability to trace key state witnesses. The Economic Freedom Fighters issued a media statement expressing their disappointment in the decision, while the National Prosecuting Authority released a statement explaining the circumstances.

Sipho Mkhatshwa, Philemon Lukhele, Albert Mduduzi Gama, and Raise Nkuna were facing charges of murder, kidnapping, and robbery with aggravating circumstances and defeating the ends of justice. The charges relate to the incident in April last year where Gardee was reported missing, and her body was found 60 kilometers away from Mbombela towards Sabie.

The decision to provisionally withdraw the charges has been met with criticism from Gardee’s family and the EFF. The EFF statement expressed concern that justice may not be served for Gardee and called for the witnesses to be found and the charges reinstated.

The National Prosecuting Authority stated that they will engage with the South African Police Service to trace the witnesses in the matter with the hope of reinstating the charges.

The case has garnered significant attention, with many calling for justice for Gardee. The provisional withdrawal of charges has left many questioning the effectiveness of the justice system and the ability to hold those responsible for crimes accountable.
